Annex to the equipment rental agreement.
B1. What this annex covers. This annex applies when equipment leaves the studio in the Renter's possession. Equipment added to a studio booking and used inside the studio is not covered by it: it stays on the premises and carries no security deposit.
B2. Who may rent. The Renter is a natural person of full legal age, or a company represented by a named person. A first-time Renter presents a valid identity document at pickup. The Lessor may refuse a handover without giving a reason, in which case any amount already paid for the rental is returned in full.
B3. Identity and personal data. The identity document is checked at the handover and is not copied, photographed or stored. The Lessor keeps only the name, the contact details and the booking record.
B4. Security deposit. A security deposit is required for every external rental. It is placed as a hold on the Renter's payment card before the pickup, paid by bank transfer before the pickup, or paid in cash at the pickup against a receipt. It is returned or released within 7 days after the equipment has been returned and inspected, subject to B14. The deposit is not a part of the rental price and is not reduced by any discount. Its amount follows the rules of the rental system: a percentage of the declared market value of the items, reduced where the Renter provides proof of their own liability insurance covering rented equipment. Without the deposit in place the equipment is not handed over.
B5. Rental price and period. The rental price, the period and the items are those confirmed in the booking. Each camera comes with two batteries, a charger and a memory card at no extra charge. The period runs from the agreed pickup time to the agreed return time. The price is paid before the equipment leaves the studio. A repeat client may ask for delivery at the fee shown in the booking; the handover and the return then take place at the agreed address under the same rules.
B6. Handover. At the handover the parties together photograph every item. Those photographs are the main record of the condition in which the equipment was handed over. The Renter confirms receipt of the listed items and that they are complete and in working order. A defect not recorded at handover is presumed to have occurred during the rental, unless the Renter shows otherwise.
B7. Use. The equipment is used for its intended purpose, by the Renter or by people under the Renter's direct supervision. The Renter does not sub-rent, lend, pledge or sell the equipment, does not modify it, does not open it and does not have it repaired. Firmware and settings may be changed; serial numbers, markings and labels may not be removed.
B8. Transport and storage. The equipment is transported in the bags and cases provided. It is not left unattended in a vehicle, in a public place or in a left-luggage facility, and it is not checked in as hold baggage. It is stored indoors, dry, and out of sight.
B9. Taking the equipment abroad. The equipment stays in Luxembourg unless the Lessor has agreed otherwise in writing before the pickup, with the destination stated.
B10. Memory cards and material. Memory cards are handed over empty and are returned empty: the Renter copies their material and deletes it from the card before the return. The Lessor does not keep, read or recover material left on a card, and deletes anything found on it. Neither party is responsible to the other for material lost this way.
B11. Insurance. The Lessor recommends liability insurance covering rented equipment and reduces the security deposit where the Renter proves they have it. Insurance is not a condition of the rental. Without it, the Renter carries the full risk described in B12.
B12. Loss, theft and damage. The Renter is responsible for the equipment from the handover until the return, including loss, theft, damage and the consequences of use by anybody they allowed to use it. Damage is charged at the cost of repair, or at the cost of replacement where repair is not economical; loss and theft are charged at the declared value of the item. The security deposit may be applied against these amounts and does not limit them. Theft and loss are reported to the Lessor without delay and to the police within 24 hours, and a copy of the report is given to the Lessor.
B13. Normal wear. Normal signs of use are not damage: surface marks on bodies, bags and cases, and consumption of the life of a battery. Dents, cracks, bent mounts, scratched glass, moisture inside a device, sand or liquid ingress, and missing parts or accessories are damage.
B14. Return and inspection. The equipment is returned complete, at the agreed time, to the studio or to the agreed delivery address. It is inspected in the Renter's presence against the handover photographs. Where damage is found, it is recorded with photographs and the Renter is given a copy of that record. The rental is not closed and the deposit is not released while a damage record is open: a decision on it is taken by a person at the Lessor, not automatically, and it is communicated to the Renter in writing.
B15. Late return. A late return is charged at one additional day price per started day of delay, and the Lessor may apply it against the deposit. Where a late return makes the Lessor break an obligation to another renter, the Renter also carries the direct cost of that.
B16. Cancellation and withdrawal. The Renter may cancel 7 days or more before the pickup and receives the amount paid back, minus the payment provider's fee where one applies. A cancellation less than 7 days before the pickup, or a failure to collect, is not refunded. A rental that has started is not refunded for unused time. These rules do not limit the right of withdrawal: a consumer who booked online may withdraw within 14 days of the booking without giving a reason; all their payments are returned without any fee within 14 days, by the same means of payment, and the deposit is returned or released. If they asked for the rental to start within those 14 days, they pay the part of the price for the time until they informed the Lessor of the withdrawal, and they lose this right once the rental is complete. Equipment already handed over is returned; B12 to B15 continue to apply.
B17. Early termination. The Lessor may terminate the rental and require immediate return where the equipment is used in breach of this annex, where it is taken abroad without agreement, or where the Lessor has reason to believe it is at risk. The rental price for the remaining period is returned; the deposit is handled under B14.
B18. Order of precedence and consumer rights. Where this annex and the rental agreement differ, this annex prevails on the matters it covers. Neither of them changes the studio rental terms published at studio.luxphotopro.lu/studio-terms, which govern the use of the studio itself. Nothing in this annex limits the rights a Renter has by law as a consumer.
